بعد رفض الطعن.. حكم نهائي بإعدام أب وسجن نجله في قضية «أغوار الأردن»

لم تُطوَ هذه القضية بمجرد صدور الأحكام الأولى، بل بقيت محل ترقب حتى جاءت الكلمة الفصل من أعلى سلطة قضائية في الأردن. وبعد سنوات من الجريمة التي هزّت الرأي العام، أُسدل الستار نهائياً على أحد أكثر الملفات الجنائية إثارة للجدل، بحكم باتّ لا يقبل الطعن.

أيدت محكمة التمييز في عمان، أمس، الأحكام النهائية الصادرة بحق أب وابنه أدينا بقتل رجل على خلفية نزاعات سابقة بين عائلتين في منطقة الأغوار الشمالية عام 2021، لتختتم بذلك مسار القضية قضائياً.

تأتي هذه الأحكام القضائية تتويجاً لسلسلة من الإجراءات القانونية التي استمرت لأكثر من عامين، في قضية أثارت جدلاً واسعاً حول سيادة القانون وعدالة العقاب في جرائم الشرف والعائلات.

وأيدت المحكمة قرار محكمة الجنايات الكبرى القاضي بإعدام الأب شنقاً حتى الموت، فيما ثبّتت الحكم الصادر بحق نجله بالأشغال الشاقة المؤقتة لمدة 20 عاماً، بعد إدانتهما بارتكاب جريمة القتل العمد والمشاركة فيها.

وكان المحكومان قدما طعناً أمام محكمة التمييز طالبين فيه إلغاء الحكم، بدعوى وجود مخالفات وأخطاء إجرائية في مراحل المحاكمة.

إلا أن المحكمة، وبعد مراجعة ملف الدعوى وما تضمنه من أدلة وشهادات، خلصت إلى أن جميع إجراءات التقاضي تمت وفق أحكام القانون، وأن البينات المقدمة كانت كافية لإثبات التهم المسندة إلى المتهمين.

وبناءً على ذلك، قررت المحكمة رد الطعن وتثبيت الأحكام الصادرة بحقهما، ليصبح القرار نهائياً وقطعياً، منهية بذلك جميع مراحل التقاضي في القضية، وفق ما أوردته وسائل إعلام محلية.

تعود وقائع الجريمة إلى يوليو 2021، حين تعرض رجل لإطلاق نار أثناء وجوده داخل مركبته برفقة أفراد من أسرته في منطقة الشونة الشمالية في محافظة إربد، مما أسفر عن إصابته بعيار ناري في الصدر توفي على إثره في مكان الحادث.

وكشفت أوراق القضية أن خلافات مستمرة كانت قائمة بين المتهمين والضحية وعائلته لأشهر عدة قبل وقوع الجريمة، وهو ما دفع أسرة المجني عليه إلى اتخاذ قرار بمغادرة المنطقة والانتقال إلى العاصمة عمّان، خشية تفاقم النزاع.

لكن، ووفقاً لما أثبتته التحقيقات، علم الأب ونجله بموعد مغادرة العائلة، فقررا تنفيذ الجريمة قبل رحيل الأسرة. وتوجها إلى مكان وجود الضحية وهما يحملان سلاحاً نارياً، قبل أن يطلقا النار باتجاهه، لتصيبه رصاصة قاتلة أنهت حياته على الفور، في جريمة انتهت اليوم بحكم قضائي نهائي أسدل الستار على واحدة من أبرز قضايا القتل التي شغلت الرأي العام في الأردن.

This case was not closed merely with the issuance of the initial rulings, but remained a subject of anticipation until the final word came from the highest judicial authority in Jordan. After years of a crime that shook public opinion, the curtain was finally drawn on one of the most controversial criminal files, with a ruling that is final and cannot be appealed.

The Court of Cassation in the Jordanian capital, Amman, yesterday (Sunday), upheld the rulings issued against a father and his son after they were convicted of killing a man following previous disputes between two families in the northern Ghor region in 2021, thus putting an end to the judicial process of the case.

The court affirmed the decision of the Grand Criminal Court sentencing the father to death by hanging, while it upheld the ruling against his son of temporary hard labor for 20 years, after both were convicted of committing and participating in the crime of premeditated murder.

The defendants had filed an appeal before the Court of Cassation, requesting the annulment of the ruling, relying on claims of procedural violations and errors during the trial stages.

However, the court, after reviewing the case file and the evidence and testimonies it contained, concluded that all litigation procedures were conducted in accordance with the law, and that the evidence presented was sufficient to prove the charges against the defendants.

Accordingly, the court decided to reject the appeal and uphold the rulings issued against them, making the decision final and conclusive, thus ending all litigation stages in the case, according to what local media reported.

The details of the crime date back to July 2021, when a man was shot while inside a vehicle with family members in the northern Shuna area of Irbid Governorate, resulting in a fatal gunshot wound to the chest and his death at the scene.

Case documents revealed that ongoing disputes had existed between the defendants and the victim and his family for several months before the crime occurred, which prompted the victim's family to decide to leave the area and move to the capital, Amman, fearing the escalation of the conflict.

However, according to what the investigations established, the father and son learned of the family's departure date, so they decided to carry out the crime before the family left. They went to the location of the victim while carrying a firearm, before shooting at him, hitting him with a fatal bullet that ended his life immediately, in a crime that concluded today with a final judicial ruling that closed the curtain on one of the most prominent murder cases that occupied public opinion in Jordan.
