Lawyer: Denying an employee statutory leave is a negative administrative decision
Lawyer Ahmed Al-Ahmad confirmed that denying an employee statutory leave is considered a negative administrative decision, stressing the need not to confuse penalties with employee rights.
Al-Ahmad explained, during a phone call on Al-Akhbariya channel, that the Board of Grievances ruled that regular leave is a statutory right of the employee that is not forfeited by negligence at work.
He pointed out that the Board of Grievances reviews mandatory or negative administrative decisions, affirming that employee rights and privileges should not be affected by penalties applied in case of breach of job duties.
He added that this principle establishes a general rule that protects employees' rights and clarifies their obligations towards the administration as well as the mechanisms of accountability and oversight by department heads and those with authority.
