A US appeals court on Tuesday temporarily halted enforcement of a ruling issued by a lower court against the global tariffs imposed by President Donald Trump's administration under Section 122 of the Trade Act, which amount to ten percent, thereby keeping the tariffs in effect for three importers who obtained an exemption from these tariffs last week.
The US Court of International Trade ruled on Friday that the new tariffs should not be applied, but it did not bar their collection on a broad scale, according to Reuters. The Trump administration appealed the ruling.
With the suspension of the ruling, the tariffs were reinstated for two companies and Washington state, which had filed a lawsuit over the tariffs. The US Court of Appeals for the Federal Circuit issued an administrative order for a short-term temporary stay of the ruling and is considering imposing a longer stay.
Washington state is considered an importer because it pays the tariffs through the University of Washington, a public research institution. The two companies and Washington state have seven days to object to a longer suspension of the ruling issued by the lower court in their favor.
The 10% global tariffs were imposed in February, after the US Supreme Court struck down most of the tariffs Trump had imposed in 2025. The 10% global tariffs are scheduled to expire in July, unless extended by Congress. The latest global tariffs were imposed under Section 122 of the Trade Act of 1974.
